§ 6.03. Board of adjustment.

  • There shall be a board of adjustment consisting of seven members appointed by the city council for a term of three years. The city council shall also appoint a special magistrate to perform the duties of the board of adjustment whenever there are vacancies on the board or when a meeting quorum of no less than four members cannot be ascertained to conduct a variance hearing within 30 days of the filing of an application. Members of the board or special magistrate shall hold no employment with the city nor hold any other appointed position with the city.

    The duties of the board of adjustment shall be as follows:

    (a)

    The board or special magistrate shall comply with those standards and procedures as may be established by the city council to hear and determine special exceptions, appeals from administrative decisions, petitions for variances in the case of peculiar and unusual circumstances, which would prevent the reasonable use of land, and such other matters as may be required by the council or by law.

    (b)

    The board of adjustment or special magistrate shall make a determination on each matter brought before it occurring within the city limits of Belleair Beach. The decision of the board or special magistrate on matters before it shall be binding on the city.
